Mr. James Seldomridge was injured when performing warranty repairs on equipment installed in the expanded General Mills, Inc. (GMI) dough processing facility, which was built by Mr. Seldomridges employer. Mr. Seldomridge sued GMI for negligence. GMI filed a motion to dismiss for lack of subject matter jurisdiction, asserting that because Mr. Seldomridge was a statutory employee his exclusive remedy was under workers compensation law. The circuit court granted GMIs motion. Because Mr. Seldomridge was working on an improvement to the facility he may bring his claim under common law. We reverse.
